Terms of Service

Effective date: June 5, 2026. This Terms of Service (the “Terms”) governs your access to and use of Etupi’s app discovery platform, including etupi.com, and any related services (the “Service”). By accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By using the Service, creating an account, or engaging with any feature offered through Etupi, you affirm that you have read, understood, and agree to be legally bound by these Terms and any additional terms referenced herein. If you do not meet these requirements or disagree with any part of the Terms, you must not access or use the Service.

2. Intellectual Property

All content appearing on the Service, including but not limited to branding, logos, text, graphics, user interfaces, source code, and underlying software, is owned by Etupi or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. You may not reproduce, modify, distribute, display, perform, publish, or create derivative works from any portion of the Service except as expressly permitted by these Terms or with Etupi’s prior written consent. Etupi’s trademarks, service marks, and trade names may not be used without prior written permission.

3. Third-Party Links and Apps Hosted on Google Play

The Service functions as a discovery platform and may include links to third-party apps that are hosted on Google Play. Etupi does not host, control, or operate the apps themselves, nor does it guarantee the availability, accuracy, or safety of those third-party offerings. Your use of any such app is governed by the terms and privacy policies of the respective app developers and by Google Play. Etupi bears no liability for the content, conduct, or performance of any third-party apps. By proceeding to install or interact with third-party apps, you acknowledge that Etupi is not responsible for the behavior of those apps or for any interactions you have with Google Play or the app developers.

4. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” ETUPI DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, SECURITY, OR TITLE. ETUPI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER, MOBILE DEVICE, OR OTHER EQUIPMENT, OR LOSS OF DATA THAT RESULTS FROM SUCH MATERIAL.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETUPI AND ITS AFFILIATES, LICENSORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR YOUR USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. IN NO EVENT SHALL ETUPI’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT PAID, IF ANY, BY YOU TO ETUPI FOR THE SERVICE IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD 100). THIS LIMITATION APPLIES TO ALL CLAIMS OF ANY KIND, WHETHER BASED IN CONTRACT, TORT, OR OTHER THEORIES OF LIABILITY.

6. Indemnification

You agree to defend, indemnify, and hold harmless Etupi, its officers, directors, employees, agents, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

7. Modifications to Terms

Etupi reserves the right to modify these Terms at any time. We may provide notice of material changes via the Service or other reasonable means. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.

8. Privacy

9. Governing Law and Disputes

These Terms and all matters arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the jurisdiction designated by Etupi, without regard to its conflict of laws provisions. Any disputes shall be resolved in the competent courts located in that jurisdiction, subject to applicable statutory protections.

10. Termination

We may suspend or terminate your access to the Service at our sole discretion for violations of these Terms, illicit activity, or harmful conduct. Upon termination, all licenses granted to you under these Terms shall cease, and you must immediately discontinue all use of the Service and destroy any downloaded materials in your possession.
